The Law and You - Data Protection

The Information Commissioner's Office (www.ico.gov.uk) is an independent official body appointed by the Queen. The Commissioner is responsible for administering the provisions of the Data Protection Act 1998 and the Freedom of Information Act 2000.

We are all affected by the 1998 Data Protection Act. However, many company directors and business owners do not realise that they can be fined or imprisoned if they fail to comply. Meet your Data Protection Act obligations - let us shred your confidential material and put an end to all your security shredding worries.

Amgen Cymru confidential shredding services can help you meet your statutory obligations - and put your mind at rest. To find out more please contact Lynne Davies (Commercial Manager) on 01685 870770.

Q: How do I know whether the Data Protection Act applies to my business / organisation?

The Act will usually apply unless you are individual holding personal information for your own domestic use, e.g. an address book.

Q: I am a data controller wanting to outsource some of our information for processing purposes. What are the data protection implications?

The seventh principle of the Data Protection Act discusses security management and control of access to information. You must choose a service provider that you consider can carry out the work in a secure way and you should check that they are doing this. You should have a written contract with them that lays down how they can use and disclose the information you have entrusted to them. It must require them to take proper security measures.

Q. What is seen as ‘confidential material’?

The definition of Personal Data as laid out in the Data Protection Act is "data which relate to a living individual who can be identified". However, Confidential Material could be defined as absolutely anything that could be detrimental to your business if it were to fall into the wrong hands.
